Introduction and acceptance
Welcome to Studible. These Terms of Service ("Terms") are a legal agreement between you and Studible ("Studible", "we", "us", "our"), operated by Noetic Labs, a company registered in Botswana (placeholder — full registered name, company number, and registered address pending registration).
These Terms govern your access to and use of:
- our marketing website at studible.co.bw;
- the Studible learner app at app.studible.co.bw and any native mobile apps we publish;
- the Thuto AI tutor; and
- any other content, features, or services we offer under the Studible brand (together, the "Service").
By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Service.
We may also publish additional rules, guidelines, or community standards for specific features. Where they apply, those additional rules form part of these Terms.
Who can use Studible & parental consent
Studible is designed for secondary school students — primarily Form 4 and Form 5 learners in Botswana — and for the parents, guardians, and teachers who support them. You may use Studible only if you meet all of these conditions:
- You are at least 13 years old, or you have the verifiable consent of a parent or legal guardian who has read and accepted these Terms on your behalf.
- If you are under 18, a parent or legal guardian must have given permission for you to create an account and is responsible for any payments made through that account.
- You are able to enter into a legally binding contract under the law that applies to you, or — where you are not — a parent or guardian has entered into these Terms on your behalf.
- Your use of Studible is not prohibited by any law that applies to you, and you have not previously been suspended or removed from the Service.
Parents and legal guardians who agree to these Terms on behalf of a minor are themselves bound by these Terms, are responsible for the minor's use of the Service, and are responsible for all charges incurred through the minor's account.
We may refuse service, suspend accounts, or terminate accounts at our discretion where these conditions are not met. Where a school has arranged Studible access on your behalf, the school's own terms with us may also apply.
Your account
To use most of the Service you need a Studible account. Accounts are created with your mobile phone number and a password; you can optionally add your email, date of birth, school, grade, and other profile details later. You agree to:
- provide accurate and current information when you register and keep your profile up to date;
- keep your password confidential and not share your account with anyone else;
- be responsible for all activity that occurs on or through your account; and
- notify us immediately at hello@studible.co.bw if you suspect any unauthorised use of your account.
We are not liable for any loss caused by your failure to keep your credentials safe.
What Studible provides
The Service currently includes, among other things:
- Structured learning content for Biology, Chemistry, Physics, and Mathematics, mapped to the BGCSE and IGCSE curricula at Form 4 and Form 5 level.
- Microlessons, worked examples, and question banks organised by concept and topic.
- Adaptive progress tracking, including concept mastery, sub-skill mastery, and suggested next lessons.
- Thuto AI, an in-app AI tutor that can answer your study questions (see section 9).
- Notifications and reminders, if you opt in, to help you meet your daily study goal.
We improve the Service continuously. Features, content, and prices may change, and we may add, remove, or modify features at any time. We will give reasonable notice of material changes where we can.
Subscriptions, pricing, and payments
Parts of the Service are available for free. Premium features require a paid subscription. Current plans and prices (all in Botswana Pula, P) are shown on our pricing page and inside the learner app. At the time of publication our plans are:
- 1 month — P99.00
- 3 months — P250.00
- 6 months — P450.00
Prices are displayed including any applicable value-added tax unless stated otherwise. Important points about our plans:
- Fixed-length access. Each paid plan gives you access for a fixed period (1, 3, or 6 months) starting on the date your payment is confirmed. Access ends automatically when the period expires.
- No automatic renewal. Plans do not auto-renew. When a plan ends, access reverts to the free tier and you can choose whether to purchase another plan.
- Payment. Payments are processed by our third-party payment provider (placeholder — provider to be confirmed). You authorise us and the payment provider to charge the payment method you use for the plan price, together with any applicable taxes and fees.
- Failed payments. If a payment fails, we may not activate your plan, and we may retry the charge with the payment provider before treating the payment as finally failed.
- Price changes. We may change our prices and plans at any time. Price changes apply only to plans purchased after the change takes effect and never to an active plan you have already paid for.
- Receipts. Receipts and invoices are available by emailing hello@studible.co.bw.
Cancellations and refunds
Because our plans are fixed-length and do not auto-renew, there is nothing to cancel in the usual subscription sense — your access simply ends when the plan expires.
We offer refunds in the following circumstances:
- Duplicate or failed charges — if you are charged twice for the same plan, or charged for a plan that was not activated, contact us and we will investigate and refund the duplicate or erroneous charge.
- Billing errors attributable to us or our payment provider.
- Material unavailability — if the Service is materially unavailable to you for an extended period due to a fault on our side, we may issue a pro-rata credit or refund.
- Cooling-off — where mandatory consumer law gives you a statutory right to cancel a distance purchase within a specified cooling-off window, that right applies even if it is not mentioned here.
Outside of those circumstances, fees for a fixed-length plan are non-refundable once the plan has been activated and used. To request a refund, email hello@studible.co.bw with your phone number and the plan in question. We aim to respond within 14 days.
Placeholder — the formal refund window (for example, "within 7 days of activation and before you have completed more than one lesson") will be confirmed on legal review and posted here.
Acceptable use
You agree that you will not, and will not help anyone else to:
- use the Service to cheat on an examination, coursework, assignment, or other assessment, or to misrepresent Studible-generated content as your own in a context where that is not permitted;
- share, resell, rent, or sublicense your account or any content delivered through it to anyone else;
- scrape, copy, download in bulk, or redistribute our lessons, question banks, illustrations, explanations, or any other material outside of personal study use;
- reverse-engineer, decompile, probe, or otherwise attempt to discover the source code of the Service except to the extent expressly permitted by law;
- interfere with, disrupt, or place unreasonable load on the Service, circumvent rate limits or security controls, or attempt to access accounts or data that do not belong to you;
- upload or submit content — including messages to Thuto AI — that is illegal, harmful, hateful, harassing, sexually explicit, promotes self-harm, or infringes anyone's rights;
- use the Service for any unlawful purpose, or in breach of Botswana law or any law that applies to you;
- use automated tools (bots, scrapers, headless browsers) to access the Service without our prior written permission; or
- attempt to manipulate Thuto AI into producing content that is unsafe, unlawful, or that contradicts these Terms.
If we reasonably believe you have broken these rules, we may remove content, restrict features, suspend or terminate your account, and — where appropriate — report the matter to the relevant authorities.
Content & intellectual property
Our content
The Service and all of its content — including microlessons, worked examples, question banks, diagrams, illustrations, audio, software, the Studible brand, logos, and overall design — are owned by Studible, Noetic Labs, or our licensors and are protected by copyright, trademark, and other laws. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own education.
This licence does not allow you to: copy, publish, broadcast, or redistribute our content; use it to train any AI or machine-learning system; remove copyright or attribution notices; or use our brand or logos without our prior written permission.
Your content
You keep ownership of the content you submit to Studible — for example, your notes, the text of your messages to Thuto, and feedback you send us ("Your Content"). By submitting Your Content, you grant Studible a worldwide, royalty-free, non-exclusive licence to host, store, transmit, copy, and process Your Content, and to create derivative works of it, solely to the extent necessary to provide the Service to you and to improve our product. We do not use Your Content to train third-party AI models, and we do not sell it.
You are solely responsible for Your Content and you represent that you have the right to submit it and that it does not infringe anyone's rights. We may remove Your Content if it breaks these Terms or if we are legally required to.
Feedback
If you send us suggestions, ideas, or feedback about the Service, we may use them freely and without obligation. You waive any claim that our use of such feedback infringes any right you have in it.
Copyright complaints
If you believe content on Studible infringes your copyright, email hello@studible.co.bw with details of the work, the allegedly infringing URL, and a statement that you have a good-faith belief that the use is not authorised. We will investigate and take appropriate action.
Thuto AI — how it works and its limits
Thuto is our in-app AI tutor. It is powered by large language models provided by Google (the Gemini family of models) and orchestrated by Studible. Thuto is a helpful study companion — but it is an AI, and you should use it with the following important caveats in mind.
- It can be wrong. Thuto sometimes produces incorrect, incomplete, outdated, or subtly misleading answers. Always cross-check important information against your textbook, your teacher, and the official syllabus — especially when preparing for formal assessments.
- It is not a qualified teacher, examiner, or adviser. Use it alongside your teacher, not instead of them. Thuto cannot mark your official examinations or guarantee any particular grade.
- It is not a medical, mental-health, legal, or financial service. If you are in distress or need professional help, please contact a trusted adult or an appropriate professional or emergency service.
- Your messages are processed by third-party AI providers. The text of your messages (with a pseudonymous user reference and the subject context) is sent to Google Gemini to generate a response, as described in our Privacy Policy.
- We retain chat history against your account so you can return to a conversation. You can delete individual chats or your entire chat history from within the learner app, and we delete your chat history when you delete your account.
- Do not rely on Thuto to make any important decision (for example, subject choice, career decisions, or anything with health, safety, or legal consequences) without consulting a qualified human.
You are responsible for how you use Thuto's output. You must not pass Thuto-generated answers off as your own work in any context where that is prohibited by your school, your exam board, or the law.
Third-party services
The Service relies on third-party providers — including Google (Gemini, Firebase, Google Cloud), MongoDB, Cloudflare, and our payment and notification providers — as described in our Privacy Policy. When you use the Service, you may also be subject to those providers' terms and privacy policies to the extent they apply to you. We select our partners carefully but we do not control what they do on their own platforms, and we are not responsible for their acts or omissions except to the extent required by law.
Disclaimers
Except as expressly stated in these Terms, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law. In particular, we do not warrant that:
- the Service will be uninterrupted, timely, error-free, or completely secure;
- every lesson, question, diagram, or AI response is free of errors;
- the Service will meet your specific learning requirements; or
- your use of Studible will result in any particular grade, examination result, school placement, or other learning outcome.
Educational outcomes depend on many factors outside our control. Studible is one tool among many — use it well, but do not rely on it as the only source of your preparation.
Nothing in these Terms excludes or limits any warranty or condition that cannot be excluded or limited under the laws of Botswana or any other law that mandatorily applies to you.
Limitation of liability
To the fullest extent permitted by law:
- Studible, Noetic Labs, and our directors, officers, employees, contractors, and partners are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or opportunity, arising out of or in connection with your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages;
- our total aggregate liability to you for any and all claims arising out of or in connection with these Terms or the Service, in any rolling twelve (12) month period, will not exceed the greater of (i) the total amount you have paid to Studible in that 12-month period, or (ii) five hundred Pula (P500.00).
Nothing in these Terms excludes or limits liability for:
- fraud or fraudulent misrepresentation;
- death or personal injury caused by our negligence;
- any other liability that cannot be excluded or limited under Botswana law or any other law that mandatorily applies to you.
If you are a consumer, your statutory rights are not affected.
Your indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Studible, Noetic Labs, and our directors, officers, employees, contractors, and partners from and against any claims, losses, damages, liabilities, costs, and reasonable legal fees arising from or related to: (a) your breach of these Terms; (b) Your Content; (c) your misuse of the Service; or (d) your violation of any law or of the rights of a third party. We will notify you promptly of any such claim and will not settle it on your behalf without your consent (which you shall not unreasonably withhold). Where you are a minor, your parent or legal guardian is jointly responsible for this indemnity.
Suspension and termination
Termination by you
You can stop using the Service at any time. You can delete your account from within the learner app (Settings → Account → Delete Account) or by emailing hello@studible.co.bw. Deleting your account removes your profile, progress data, and Thuto chat history as described in our Privacy Policy; it does not automatically refund any plan you have already paid for (see section 6).
Termination by us
We may suspend or terminate your access to all or part of the Service, with or without notice, if:
- you breach these Terms or any additional rules that apply to a feature;
- we reasonably believe you have engaged in fraud, abuse, or activity that is harmful to other users or to us;
- we are required to do so by law or by a competent authority; or
- we decide to discontinue the Service or the affected feature.
If we permanently discontinue a paid feature you have already paid for, we will refund a fair proportion of any pre-paid amount that covers the period after the feature is withdrawn.
Effect of termination
Termination ends your licence to use the Service. Sections of these Terms that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnity, governing law, and this section — will survive termination.
Changes to these Terms
We may update these Terms from time to time to reflect changes in the Service, in our business, or in the law. When we make a material change, we will update the "Last updated" date at the top of the page and — where the change is significant and we can reach you — notify you by email, SMS, or in-app message at least 14 days before the change takes effect. Continued use of the Service after the change takes effect means you accept the updated Terms. If you do not agree, you should stop using the Service and may delete your account.
Governing law and disputes
These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes), are governed by the laws of the Republic of Botswana.
Before starting any formal dispute, please contact us first at hello@studible.co.bw. We'd rather talk and find a fair solution. If we can't resolve the dispute informally within 30 days, any dispute will be subject to the exclusive jurisdiction of the courts of Botswana, except where mandatory local consumer-protection law gives you the right to bring proceedings in another jurisdiction.
General
- Entire agreement. These Terms, together with our Privacy Policy and any additional feature-specific rules, form the entire agreement between you and us regarding the Service, and supersede any earlier agreements.
- Severability. If any part of these Terms is held to be unenforceable, the rest remains in full force.
- No waiver. Our failure to enforce a right is not a waiver of that right.
- Assignment. You may not assign these Terms or any of your rights under them without our prior written consent. We may assign these Terms to an affiliate or a successor in connection with a corporate reorganisation, merger, or sale of assets.
- No third-party rights. Except where expressly stated, these Terms do not create any rights enforceable by anyone other than you and us.
- Force majeure. Neither party is liable for delay or failure caused by events beyond reasonable control (for example, natural disasters, power or internet outages, acts of government).
- Notices. We may send notices to the phone number or email on your account, or by posting them in the app or on the website. You may send notices to us at hello@studible.co.bw.
- Language. These Terms are written in English. Translations are for convenience only; the English text prevails.
